Vinh Le is an associate based out of Redwood City, California. He focuses his practice on solving intellectual property issues for Silicon Valley clients across a wide range of contexts and technologies, including enterprise and consumer products, computer software and hardware, data encryption, internet content delivery and load balancing, network communications, consumer electronics and computer peripherals, video gaming, pharmaceuticals and biotechnology. His experience also includes representing both plaintiffs and defendants in intellectual property litigation and licensing disputes.

Prior to joining Bunsow De Mory, Mr. Le was at an intellectual property litigation boutique in Silicon Valley where he worked on many high-stakes intellectual property and commercial disputes. Mr. Le has substantial experience litigating complex pharmaceutical cases at a plaintiff-focused boutique firm, Kershaw Talley Barlow. He also formerly worked as a litigation and commercial associate at Rimon P.C. in Palo Alto.

Mr. Le earned his J.D. from Emory University. He earned a B.S. in Biology from the University of Washington with a focus on cellular and molecular biology and physiology. Prior to law school, Vinh was a research scientist at the Department of Biological Structure at the University of Washington. There, he investigated the neural basis of visual shape representation and recognition through computational modeling and lab work.

Mr. Le participates in and supports numerous bar associations including the Asian Pacific American Bar Association of Silicon Valley.  Outside of his intellectual property practice, Mr. Le enjoys playing tennis and spending time at his family’s organic farm.

Represented a Fortune 100 corporation against allegations of patent infringement in the Western District of Texas related to game purchases, video game wishlists, in-game purchases, and real-time in-game messaging systems.

      Counseled numerous online service providers regarding DMCA, trademark applications, and disputes with parties in the same or adjacent industries. 

      • Confidential Patent Litigation Dispute: Network Interface Devices

      Represented Silicon Valley semiconductor company in a patent infringement action involving network protocol processing with a load balancing hardware component.

       

      • Confidential Patent Litigation Dispute: Network Interface Devices

      Represented popular consumer electronics manufacturer in a patent infringement action involving wireless transfer of data to consumer products and online publishing services. Obtained favorable judgment on behalf of client. Affirmed by the Federal Circuit.

      Represented a Fortune 100 corporation regarding alleged breach of licensing agreement and related royalties with respect to video game publishing.

      Represented a Fortune 100 corporation against allegations of breach of contract and demands for business losses relating to various merchandise licensing agreements.

      • Confidential Due Diligence of Target Company Intellectual Property Assets
        Counseled Chinese company on potential acquisition of another company’s intellectual property assets, including analysis and evaluation of patents, software licensing, and supplier agreements.

      Served on court-appointed leadership committees in Gilead Tenofovir Cases involving FDA regulations applicable to pharmaceutical products. 

      • Essure Product Cases 

      Worked on equitable settlement allocation formula accepted by special master for $1.6B settlement in Essure litigation relating to medical products.
