Firm partner James Wilson, an experienced patent litigator and PTAB practitioner, has created several PTAB Discretionary Denial Dashboards that provide big picture and detailed analytics on the discretionary denial process at the U.S. Patent and Trademark Office.
The three dashboards track in increasing levels of detail the actions taken by Petitioners, Patent Owners, and the PTO Director when the Patent Owner requests that the Director exercises discretion to deny an inter partes review (“IPR”) petition or a post-grant review (“PGR”) petition.
The top-level dashboard tracks Patent Owner discretionary denial briefs, Petitioner opposition briefs, the PTO Director’s decisions. The visual layout allows for easy analysis of outcomes and trends on discretionary denial requests. A link to Wilson’s PTAB Discretionary Denial Dashboard is here.
In the second dashboard, Wilson takes a deep dive into trends over time in the discretionary denial process, including how many requests are made each month and what happens at the PTAB when the Director refers an IPR or PGR for review on the merits. The third dashboard analyzes discretionary denial outcomes by the nine technology center categories recognized by the PTO: Biotech and Organic Chemistry; Chemistry and Materials Engineering; Computer Architecture and Software; Communications; Computer Networks and Multiplex Communications; Semiconductors, Electronics and Optics; eCommerce, Transportation and Construction; Mechanical Engineering and Manufacturing; and Reexaminations. Wilson built the dashboards using the Patent Office’s PTAB API v.2 to provide real-time insights on discretionary denial trends. All three dashboards auto-update daily with the latest PTAB data.
