Bunsow De Mory Secures Jury Verdict of $110.7 Million for Client TOT Power Control, S.L. In Patent Infringement Case Against Apple, Inc.

A trial team from Bunsow De Mory, led by Managing Partner Denise De Mory, secured a sweeping victory for client TOT Power Control, S.L. against Apple, Inc. in a patent infringement lawsuit in federal district court in Delaware.  

Bunsow De Mory worked with co-counsel from Hausfeld LLP, Kelly Legal PLLC, and Farnan LLP. 

After a three-day trial in June 2025, the jury returned a verdict for $110,738,008 in patent infringement damages for TOT Power Control and rejected Apple’s patent invalidity defense. U.S. District Judge Maryellen Noreika presided over the trial. 

The $110,000,000-plus patent damages verdict is the third largest in a patent infringement case in 2025, and the largest in the District of Delaware this year. 

TOT Power Control alleged that Apple infringed two patents—U.S. Patent No. 7,532,865 and U.S. Patent No. 7,496,376—which claimed important technological improvements to 3G technology that enable significant power savings, greatly increasing a mobile phone’s available bandwidth for data.  

The jury found that Apple infringed U.S. Patent No. 7,532,865, found the patent valid, and awarded a $0.25 running royalty. Should the Court award the full amount of prejudgment interest sought by TOT Power Control, the final judgment could top more than $140,000,000. 

TOT Power Control’s CEO Alvaro Lopez-Medrano said after the jury verdict, “TOT Power Control SL is thrilled that its fundamental cellular power saving technology has been validated by a jury in Delaware. We are grateful to our outstanding legal team and all of our stakeholders for their invaluable support in helping us achieve this remarkable victory.” 

The jury verdict against Apple is only part of TOT’s broader campaign to enforce its intellectual property rights against major players in the mobile device industry. Similar lawsuits filed by TOT against LG Electronics and Samsung Electronics are currently pending in Delaware federal court, with trials scheduled for January 2026 and February 2026, respectively.
