Jury Returns $33.8 Million Verdict for Bunsow De Mory Client ViaTech Technologies Inc. In Patent Infringement Case Against Adobe Inc.

A trial team from Bunsow De Mory secured a sweeping victory for client ViaTech Technologies Inc. against Adobe Inc. in a patent infringement lawsuit in federal district court in Delaware.

After a four-day trial in September 2023, the jury returned a verdict for nearly $33.8 million for ViaTech and rejected Adobe’s patent invalidity defenses. U.S. District Judge Richard Andrews presided over the trial.

ViaTech provides software e-commerce tools and solutions for distributing and protecting digital content. The patent at issue—U.S. Patent No. 6,920,567—claims advances in technology for performing license checks.

ViaTech alleged that Adobe’s software applications such as Photoshop and Illustrator infringed all the asserted claims in Viatech’s patent. The jury agreed.

The $33.8 million jury verdict awarded ViaTech the full amount of damages it sought at trial. Should the Court award the full amount of prejudgment interest sought by ViaTech, the final judgment could reach $43 million.
