Darrell R. Atkinson is experienced in both federal and state trial and appellate court practice, representing clients in intellectual property, complex contract, and corporate governance disputes.
Darrell’s patent trial court representations have been technologically diverse, and include internet predictive search, enterprise security, small drug molecule, mobile payment, and furniture design matters. Darrell’s patent appellate experience includes oral argument before the Federal Circuit. His patent practice also includes portfolio and joint venture counseling, license negotiation and drafting, and arbitration representation.
Darrell also has extensive experience in litigating trade secret misappropriation and complex-technology contract cases. His breach of contract representations have included non-disclosure, non-compete, licensing, development, and manufacturing agreement disputes.
Darrell’s IP specific experience extends to copyright and trademark litigation. And he has litigated business torts and done antitrust work. He has litigated cases that involve various industries, including cases in the fields of fintech, cryptocurrency, collaboration software, medical device, stratospheric balloons, and entertainment.
Darrell was with the plaintiff-side focused, litigation boutique, Hosie Rice LLP for many years, where he progressed from associate to partner. Darrell graduated from Stanford Law School where he was co-editor-in-chief of the Stanford Journal of Law, Science & Policy and a research/teaching assistant for a class on the challenges facing copyright industries in the digital era.
Darrell enjoys exploring new restaurants, dislikes missing a workout, and is committed to convincing himself that he will get back into tennis one day.

FiTeq Inc. v. Venture Corporation, et al. (N.D. Cal.): Represented a fintech “smart card” technology company in a breach of development contract and fraud action against a Singapore-based contract manufacturing entity. The case was successfully tried to jury verdict in favor of the client. The matter settled shortly thereafter.
