Bunsow De Mory Secures Favorable Settlement with Samsung on the Courthouse Steps, on Behalf of Image Processing Technologies

(Marshall, TX) – Bunsow De Mory is pleased to announce that it has reached a favorable settlement on behalf of Image Processing Technologies, LLC, in long-running litigation against Samsung in the Eastern District of Texas.  The settlement follows a string of pre-trial motion victories achieved by Bunsow De Mory, and resulted in the cancellation of what would have been the first jury trial of a patent case since the COVID-19 pandemic shut-downs.

Image Processing had brought a lawsuit against Samsung in 2016, represented by Bunsow De Mory partner Michael Zachary at his former firm.  The lawsuit asserted patents related to a processor for the automatic detection of images, and accused facial recognition features of Samsung’s smartphones and tablets of infringement.  After successfully navigating years of Samsung’s challenges in court, as well as via inter partes reviews and ex parte reexaminations in the Patent Office, one of the patent claims was severed and set for trial by Chief District Judge Rodney Gilstrap. Members of Bunsow De Mory’s trial team who had travelled to Marshall, Texas ended up with a much shorter stay than expected after the favorable settlement interrupted their on-site preparations.  Partner Corey Johanningmeier said that while he had looked forward to presenting the case to the jury, the local crawfish etouffee take-out that he enjoyed instead was worth the trip.
